Lewis Over a century ago James Riddell pointed out that Socrates' defense speech in die Apology closely followed the standard form of Athenian forensic rhetoric. He called the Apology "artistic to the core," and he identified parts of "the subde rhetoric of this defense."1 Since then many scholars have explicated the rhetorical elements in Socrates' (...) defense.2 Their work has led in turn to recent attempts to integrate the rhetorical form into an overall understanding of the meaning and significance of the Apology? The puzzle to be solved is what to make of the fact that Socrates disclaims the ability and the intention to use rhetoric in a speech which is itself a rhetorical masterpiece. R. E. Allen raises the possibility thatby using the techniques ofrhetoric and at the same time denying that he is using them Socrates is dissembling or lying. However, Allen rejects this possibility and interprets Socrates' falsehood as only a surface or apparent falsehood. According to Allen it is ironic parody of a disreputable rhetoric which seeks to convince without concern for the truth.4 For Allen the object of the parody is base rhetoric in general, the type of rhetoric denounced by Socrates in the Gorgias as "rhetoric aiming at gratification and pleasure, and indifferent to truth and the good of the soul."5 Two subsequent articles, one by Kenneth Seeskin, the other by Douglas Feaver andJohn Hare, support the view that Socrates is parodying the debased form of rhetoric. However, they place somewhat different emphasis on the exact object of the parody. They argue that the object of Socrates' rhetorical parody is Gorgias' Pahmedes, rather than pandering rhetoric in general.6 After summarizing the many rhetorical similarities between Gorgias' Palamedes and Socrates' defense speech, Seeskin concludes that "Gorgias' Philosophy and Literature, © 1990, 14: 359-366 360Philosophy and Literature Palamedes is not a masterpiece of world literature; it is a collection of topoi—tried and true devices for winning acquittal... [whereas] despite his disclaimer, Socrates' speech is no amateur performance. On the contrary, he knew all the tricks of the trade and employed them with consummate skill" (p. 97). Seeskin uses Plato's Gorgias to explain how Socrates' rhetoric fits within an overall understanding of the Apology. He notes the two types ofrhetoric presented in the Gorgias: base rhetoric, a species of flattery which aims at gratification; and philosophic or true rhetoric which aims at improving the soul. Then Seeskin makes a crucial point. He insists it is not enough to distinguish between base rhetoric and philosophic rhetoric; there must be a way to identify a given instance of rhetoric as either base rhetoric or as philosophic rhetoric. Moreover, he cautions that distinguishing the one from the other is no easy task. "It is impossible to tell them apart on the basis of technique alone. Base rhetoric is no less polished for its baseness.... Nor can one tell them apart on the basis of their stated goals. Flattery succeeds only to the extent that it can pass itself off as something better" (p. 98). Thus, if Socrates and Palamedes employ the same rhetorical devices, Seeskin wonders how we can tell which type ofrhetoric is in the Apology. "Somewhere in the Apology of Socrates there ought to be a clue which allows one to distinguish his defense from the 'standard' defense composed by Gorgias" (p. 99). Seeskin finds the clue in the exordium, where Socrates denies that he is a skillful speaker: "Unless, of course, by a skillful speaker they mean one who speaks the truth. If that is what they mean, I would agree that I am an orator, though not after their pattern" (17b). Although Palamedes makes a comparable claim, Seeskin argues that Palamedes was concerned with appearance rather than truth, and that the key to appearance is the use of the argument from probability. While Rousseau critiqued the pedagogical value of the fable, his own pedagogical project is informed by many of the qualities that he attributed to the fable. This return of the fable is enacted through Rousseau's writing on three interconnected levels: the question of the maxim, the paradox of truth, and the paradox of freedom. Lewis argues that if we take seriously the textually fabulous dimension of Emile, then the reader is left exposed to the very same anxieties as a child who is confronted with the ambiguity of the fable. Aquinas’s Theory of Natural Law: An Analytic Reconstruction. Oxford: Clarendon Press, 1996. Pp. xv + 320. Paper, $24.95.This volume aims to provide an explication of the natural law theory of St. Thomas Aquinas “consistent with the expectation of philosophers in the analytic tradition” (10–11, 17). Accordingly, the author begins, in the (...) first three chapters, by reviewing the recent history of Anglo-American metaethics, aligning himself broadly with those critics of analytic ethics like G. E. M. Anscombe, Alasdair MacIntyre, John Finnis, Martha Nussbaum, and Henry Veatch, who have argued for a recovery of Aristotelian moral theory, against varieties of intuitionism, non-cognitivism, and neo-Kantianism. Lisska’s principal objective is to present a reconstructed natural law theory based primarily on Aquinas’s discussion in questions 90–97 of the prima secundae of the Summa theologiae (a translation of these questions is appended to the book). This he offers mostly in the fourth, fifth and eighth chapters of the book. The sixth chapter is a critique of John Finnis’s account of natural law and the seventh is an exposition of the views of Henry [End Page 526] Veatch. The ninth chapter presents some suggestions on how the author’s account can illuminate controversies over the grounding of human rights, and the tenth is a brief conclusion.The three introductory chapters consist mainly of a review and endorsement of the critics of academic ethics since Moore’s Prıncipia Ethıca. Having accepted arguments for the inadequacy of modern ethics, Lisska argues for the recovery of Aquinas’s views which he sees as in fundamental continuity with Aristotelian ethics (84, 89, 100, 102–105, 108, 134–36). His central thesis is that natural law is a “second-order inquiry” based on a realist metaphysics of the human person as defined by a set of dispositional properties, the realization of which constitutes Aristotelian eudaimonia and Thomistic beatitudo (17, 104–106, 131–37, 152–55, 186, 195–201). Moreover, Lisska contends that Aristotelian “eudaimonism” constitutes an adequate account of moral obligation: what he calls, after Veatch, “obligatory teleology” (107–109, 121, 202–205, 235).At the core of Lisska’s account, then, is a metaphysical dispute that pits Aristotelian essentialism against modern reductionist ontology. This metaphysical core is separated from any theological implications in the fifth chapter (especially 119–23, 137) and Lisska reinforces his metaphysical thesis by appealing to Saul Kripke’s discussion of natural kinds and the early work of Hilary Putnam (97–99, 125, 206–209). Given the centrality of metaphysical argument, a critique of Finnis’s theory goes without saying, and Lisska devotes a chapter to it, adding another to expound Henry Veatch’s contrary view.While this book undertakes an important effort to recover a workable natural law theory—especially in its commendable stress on metaphysical questions—it is, as a whole, less satisfactory than it might have been. A good part of this owes to the book’s abstraction from historical questions. No sustained attention is devoted to the problems that accompanied the reception of Aristotle by Christian theologians, nor to the place of natural law in Aquinas’s overall understanding of morality. The former point is not so surprising, given the book’s analytic concerns; the latter, however, carries more serious theoretical implications. Why is it, for example, that natural law takes up so little space compared to the questions on happiness, human acts, and the habits and virtues in the prima secundae, not to mention the detailed treatments of the virtues and vices in the secunda secundae? Similarly, where Aquinas stresses that natural law as law is directed to the common good (Iallae 90.2), Lisska treats it mostly as a guide to “self-realization.”This issue suggests the tensions between Aristotle and Aquinas, tensions that seem to show themselves precisely in Aquinas’s discussion of the very notion of natural law, a notion that has no equivalent in Aristotle. This paper follows Part I of our essay on case-intensional first-order logic (CIFOL; Belnap and Müller (2013)). We introduce a framework of branching histories to take account of indeterminism. Our system BH-CIFOL adds structure to the cases, which in Part I formed just a set: a case in BH-CIFOL is a moment/history pair, specifying both an element of a partial ordering of moments and one of the total courses of events (extending all the way into the future) that that moment (...) is part of. This framework allows us to define the familiar Ockhamist temporal/modal connectives, most notably for past, future, and settledness. The novelty of our framework becomes visible in our discussion of substances in branching histories, i.e., in its first-order part. That discussion shows how the basic idea of tracing an individual thing from case to case via an absolute property is applicable in a branching histories framework. We stress the importance of keeping apart extensionality and moment-definiteness, and give a formal account of how the specification of natural sortals and natural qualities turns out to be a coordination task in BH-CIFOL. We also provide a detailed answer to Lewis’s well-known argument against branching histories, exposing the fallacy in that argument. (shrink)

It is only in the last few decades that analytic philosophers in particular have begun to pay any serious attention to the topic of life’s meaning. Such philosophers, however, do not usually attempt to answer or analyse the traditional question ‘What is the meaning of life?’, but rather the subtly different question ‘What makes a life meaningful?’ and it is generally assumed that the latter can be discussed independently of the former. Nevertheless, this paper will argue that the two questions (...) are indeed connected, and that identifying and expanding upon the most plausible analysis of the former will provide the resources necessary to determine the most plausible answer to the latter. Specifically, this paper will argue that the traditional question is simply a request for the information which constitutes a coherent answer to one or more of a certain set of questions regarding human existence that were salient to the asker. In simpler language, the meaning of life itself is the information a person needs to make sense of it. This analysis can then also be applied to individual lives, such that asking for the meaning of X’s life is an analogous request for the information necessary to make sense of that life in particular. Running with this concept of the ‘meaning’ of something as its ‘sense’, the paper then outlines an accompanying theory of ‘meaningfulness’ as ‘sensefulness’: a measure of the richness of certain aspects of the life, multiplied by their intelligibility. Duncan Purves and Nicolas Delon have argued that one’s life will be meaningful to the extent that one contributes to valuable states of affairs and this contribution is a result of one’s intentional actions. They then argue, contrary to some theorists’ intuitions, that non-human animals are capable of fulfilling these requirements, and that this finding might entail important things for the animal ethics movement. In this paper, I also argue that things besides human beings can have meaningful existences, but I (...) disagree with Purves and Delon’s theory of meaning, and some of the practical implications they suggest arise from their conclusion. Specifically, I argue that Purves and Delon are wrong to suggest that intentional agency is necessary for one’s life to be meaningful; contributing to valuable states of affairs can be sufficient by itself. But what constitutes this ‘belonging’ precisely? This paper proposes that belonging, in the targeted sense, is determined by meaningful connections between an object or practice and the relevant culture—in other words, connections that could be described as the thing’s ‘meanings’. Such (...) meanings primarily include relations of causality, teleology, and symbolic representation. After expounding this account, the paper closes with a word of caution. The term ‘belongs’ is sometimes ambiguous, indicating both affiliation and legal or moral property rights. Despite this, belonging as affiliation or meaningful connectedness is not equivalent to rightful ownership. Nor does the former, by itself, entail the latter. (shrink)

Susan Wolf defines a meaningful life as one that is somewhat successfully engaged in promoting positive value. I grant this claim; however, I disagree with Wolf’s theory about why we desire meaningfulness, so understood. She suggests that the human desire for meaningfulness is derived from an awareness of ourselves as equally insignificant in the universe and a resulting anti-solipsistic concern for promoting goodness outside the boundaries of our own lives. I accept that this may succeed in explaining why people want (...) to engage in projects that happen to be meaningful. Nevertheless, I argue that Wolf fails to explain why people have a desire for meaningfulness itself. In other words, she has told us one reason we may be motivated to promote positive value, but not why we personally want to be the people who promote it—why we think it is a good thing that meaningful acts be done, but not why we want them to be our meaningful acts. In detailing my response, I follow Wolf in relating our desire for meaningfulness to a kind of love-based motivation. However, I argue that it has more in common with a selfish form of love than the altruistic kind of love proposed by Wolf. Finally, I suggest an alternative explanation which I believe can more fully account for our desire for meaningfulness: the prospect of disappearing from the universe without a trace makes us anxious, so we pursue meaningful achievements in an attempt to make our own physical deaths less final. In this paper, I assess the claim that death renders life absurd. First, I characterize absurdity as something we perceive in situations involving extreme disharmonies which strike us as unexpected or unacceptable. Next, I outline several potential disharmonies which death might introduce into our existence (such as the disharmony between our dignity and capacities, and the undignified annihilation which death promises), but suggest that these examples need not be seen as necessarily absurd; there are perspectives available to us from which (...) these facts can appear to be acceptable aspects of life. Finally, I consider a more problematic case of absurdity—that human beings allegedly fail to grasp the truth of their mortality—but suggest that the underlying disharmony here can be eliminated provided we develop an authentic attitude toward death (and that this is possible, despite some objections). In short, I argue that none of the most obvious potential absurdities which might arise from our mortality are strong enough to entail the claim that death inevitably renders life absurd, at least on one plausible and interesting interpretation of that claim. Philosophers, archeologists, and other heritage professionals often take a rather negative view of heritage reconstruction, holding that it is inappropriate or even impermissible. In this essay, we argue that taking such hardline attitudes toward the reconstruction of heritage is unjustified. To the contrary, we believe that the reconstruction of heritage can be both permissible and beneficial, all things considered. In other words, sometimes we have good reasons, on balance, to pursue reconstructions, and doing so can be morally acceptable. In defending (...) this claim, we discern a number of arguments made against heritage reconstruction and demonstrate that these arguments are either exaggerated or lack support. (shrink)

This volume—which celebrates the occasion of his seventy-fifth birthday—includes contributions from colleagues, friends, and formers students and pays tribute to McBride’s considerable achievements as a teacher, mentor, and scholar.

The path of those who would approach the study of Bentham's writings on Evidence has been considerably smoothed by the recent publication of William Twining's work on the evidence theories of Bentham and Wigmore. The material on evidence is now being tackled by the Bentham Project. It presents no easy task. The central core, The Rationale of Judicial Evidence, edited and published by John Stuart Mill in 1827, exists only in the printed version, the MSS from which Mill worked having (...) disappeared. But a substantial body of related material which survives has yet to be thoroughly investigated, though William Twining has made a gallant start. A new edition of the work hitherto known as ‘An Introductory View of the Rationale of Evidence’, first printed in full in the Bowring edition of the Works of Jeremy Bentham is in preparation. The first fruits of this endeavour is that the title of that work as it should appear in due course in the new Collected Works will be Introduction to the Rationale of Evidence: An Introductory View for the Use of Lawyers as well as Non-lawyers, the title in fact given to the work by Bentham. It is intended that what follows should similarly be of use to non-lawyers as well as lawyers. (shrink)

Recent work in the history of philosophy of science details the Kantianism of philosophers often thought opposed to one another, e.g., Hans Reichenbach, C.I. Lewis, Rudolf Carnap, and Thomas Kuhn. Historians of philosophy of science in the last two decades have been particularly interested in the Kantianism of Reichenbach, Carnap, and Kuhn, and more recently, of Lewis. While recent historical work focuses on recovering the threatened-to-be-forgotten Kantian themes of early twentieth-century philosophy of science, we should not elide (...) the differences between the Kantian strands running throughout this work. In this paper, I disentangle a few of these strands in the work of Reichenbach and Lewis focusing especially on their theories of relativized, constitutive a priori principles in empirical knowledge. In particular, I highlight three related differences between Reichenbach and Lewis concerning their motivations in analyzing scientific knowledge and scientific practice, their differing conceptions of constitutivity, and their relativization of constitutive a priori principles. In light of these differences, I argue Lewis’s Kantianism is more similar to Kuhn’s Kantianism than Reichenbach’s, and so might be of more contemporary relevance to social and practice-based approaches to the philosophy of science. For the first time, Walter Benjamin's critical comments on educator and philosopher Rudolf Steiner are examined in depth. In particular, Benjamin detected protofascist themes within Steiner's seemingly progressive notion of child-centered, arts-based, developmentally appropriate early childhood education. But this does not mean that Benjamin completely rejected Steiner's work as mere ideology. Instead, we can find the subtle trace of Steiner's influence in Benjamin's own reflections on childhood. Here Tyson E. Lewis calls for a dialectical approach modeled by Benjamin that (...) allows us to critically interrogate Steiner's progressive education for protofascist tendencies, while also redeeming various insights into the lives of children. This dialectical approach to understanding the complex relationship between progressive education and fascism is now more urgent than ever before. (shrink)

The destruction of cultural heritage in war is currently attracting considerable attention. ISIS’s campaign of deliberate destruction across the Middle East was met with widespread horror and calls for some kind of international response. The United States attracted criticism for both its accidental damaging of Ancient Babylon in 2015 and its failure to protect the Mosul Museum from looters in 2003. In 2016, the International Criminal Court prosecuted its first case of the destruction of heritage as a war crime. While (...) the destruction of heritage is widely condemned, there has also been condemnation of calls to mobilize our resources for the sake of heritage protection when human beings face threats to life and limb. Such issues are both philosophically rich and personally significant to a wide range of people. And yet they have been largely neglected by academic philosophers. This book makes a substantial contribution to developing this new philosophical territory. The contributors are a mixture of internationally recognized authorities in their fields and early-career researchers working in this area. Their eleven original essays investigate a variety of philosophical and ethical issues arising from the phenomenon of heritage destruction in war, including conflicts between protecting heritage and protecting people, how we ought to respond to heritage that is damaged in war, the nature of the harm caused by such damage, and the morally appropriate treatment of sites of war and conflict that have themselves become heritage sites. In this paper, we pose a speculative encounter between Heidegger and the Chinese Song Dynasty landscape painter Xia Gui. Our intention is to reassess Heidegger’s theory of the fourfold. By placing the concept in a cross-cultural context, we argue that Heidegger was essentially correct in that the world is structured as a fold between interrelated elements. At the same time, we challenge the quantity and quality of the folded elements. If one turns to the work of Xia Gui in conjunction (...) with relevant Daoist texts, what one finds is a threefold structure to the world, composed of earth, sky, and mortals without Heidegger’s emphasis on divinities. In conclusion, we suggest that studying the folding structure of the world ought to be done through cultural comparisons of philosophical and aesthetic traditions in order to understand the potentiality for worldhood as an xfold.
